{"id":1403,"date":"2014-11-18T04:21:33","date_gmt":"2014-11-18T04:21:33","guid":{"rendered":"https:\/\/www.iuhrdf.org\/en\/2014\/11\/18\/lawyers-cite-procedural-violations-await-decision-appeal-ilham-tohti-case\/"},"modified":"2014-11-18T04:21:33","modified_gmt":"2014-11-18T04:21:33","slug":"lawyers-cite-procedural-violations-await-decision-appeal-ilham-tohti-case","status":"publish","type":"post","link":"https:\/\/iuhrdf.org\/en\/lawyers-cite-procedural-violations-await-decision-appeal-ilham-tohti-case\/","title":{"rendered":"Lawyers Cite Procedural Violations, Await Decision on Appeal in Ilham Tohti Case"},"content":{"rendered":"<p>On September 23, 2014, a court in Urumqi city, Xinjiang Uyghur Autonomous Region (XUAR) sentenced Uyghur scholar Ilham Tohti to life in prison on the charge of \u201cseparatism.\u201d <\/p>\n<div>\n<p>November 17, 2014<\/p>\n<div>\n<div>\n<div>\n<p><em>On September 23, 2014, a court in Urumqi city, Xinjiang Uyghur Autonomous Region (XUAR) sentenced Uyghur scholar Ilham Tohti to life in prison on the charge of \u201cseparatism.\u201d After the verdict, Chinese state media released a detailed written account and a video segment featuring material prosecutors presented as evidence during Tohti\u2019s trial. On October 1, Tohti\u2019s lawyers submitted an appeal on his behalf. Tohti\u2019s lawyers have stated that authorities failed to abide by due process of law in their handling of the case, including by trying the case in Urumqi and refusing to call any of the witnesses the defense had requested to testify at Tohti\u2019s trial. In addition, Tohti\u2019s family expressed apprehension about his health and one of Tohti\u2019s lawyers expressed concern that Tohti\u2019s students, detained around the same time in January 2014, may be tried in secret.&nbsp; <\/em><\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<\/div>\n<p><strong>Tohti\u2019s Trial, Verdict, and Appeal <\/strong><\/p>\n<p>On September 23, 2014, the Urumqi Intermediate People\u2019s Court convicted Uyghur scholar <a href=\"http:\/\/ppdcecc.gov\/QueryResultsDetail.aspx?PrisonerNum=7509\">Ilham Tohti<\/a> to life in prison on the charge of \u201cseparatism,\u201d<a href=\"#_edn1\" id=\"_ednref1\" name=\"_ednref1\" title=\"\">[1]<\/a> a crime falling under the category of \u201cendangering state security.\u201d<a href=\"#_edn2\" id=\"_ednref2\" name=\"_ednref2\" title=\"\">[2]<\/a> Tohti, a professor at Minzu University in Beijing and founder of the Web site Uyghur Online (<a href=\"http:\/\/www.uighurbiz.net\/\">http:\/\/www.uighurbiz.net\/<\/a>), had criticized Chinese government policy in the XUAR on the Web site and elsewhere.<a href=\"#_edn3\" id=\"_ednref3\" name=\"_ednref3\" title=\"\">[3]<\/a> At Tohti\u2019s trial, which took place on September 17 and 18, 2014,<a href=\"#_edn4\" id=\"_ednref4\" name=\"_ednref4\" title=\"\">[4]<\/a> prosecutors told the court that Tohti had \u201cspread lessons containing separatist thoughts\u201d via Uyghur Online, \u201ccoerced students to work for the Web site and built a criminal syndicate,\u201d and \u201cincited ethnic hatred by distorting the causes of a number of riots and disputes that occurred in Xinjiang and Beijing.\u201d<a href=\"#_edn5\" id=\"_ednref5\" name=\"_ednref5\" title=\"\">[5]<\/a> According to the official verdict, the court found Tohti guilty of separatism under Article 103(1) of the <a href=\"http:\/\/www.cecc.gov\/resources\/legal-provisions\/criminal-law-of-the-peoples-republic-of-china\">PRC Criminal Law<\/a> (CL); committing a crime jointly with two or more persons, under Article 25(1) of the CL; and organizing and leading a criminal group in carrying out criminal activities, under Article 26 of the CL.<a href=\"#_edn6\" id=\"_ednref6\" name=\"_ednref6\" title=\"\">[6]<\/a><\/p>\n<p>On October 1, 2014, Tohti\u2019s lawyers, Li Fangping and Liu Xiaoyuan, submitted an appeal on his behalf.<a href=\"#_edn7\" id=\"_ednref7\" name=\"_ednref7\" title=\"\">[7]<\/a> On October 10, a staff member of the Urumqi Intermediate People\u2019s Court reportedly told Liu that on October 9, the court had transferred the appeal to the XUAR High People\u2019s Court.<a href=\"#_edn8\" id=\"_ednref8\" name=\"_ednref8\" title=\"\">[8]<\/a> Court authorities reportedly notified Tohti\u2019s lawyers on November 11 that the court of second instance would conduct a written review on the appeal instead of holding a hearing.<a href=\"#_edn9\" id=\"_ednref9\" name=\"_ednref9\" title=\"\">[9]<\/a> According to Article 232 of the <a href=\"http:\/\/lawprofessors.typepad.com\/files\/130101-crim-pro-law-as-amended-en.pdf\">PRC Criminal Procedure Law<\/a>, the court of second instance should (in most cases) reach a decision on an appeal within two months of receiving it.<\/p>\n<p><strong>State Media Account of Tohti\u2019s Trial<\/strong><\/p>\n<p>On September 24, Xinhua, a state-run media outlet, published an account of Tohti\u2019s trial proceedings, including evidence presented by prosecutors in support of the charge of \u201cseparatism.\u201d<a href=\"#_edn10\" id=\"_ednref10\" name=\"_ednref10\" title=\"\">[10]<\/a> On September 25, Chinese Central Television (CCTV) broadcast a 15-minute video segment regarding the trial that included interviews of detained students of Tohti and footage from Tohti\u2019s classroom lectures at Minzu University.<a href=\"#_edn11\" id=\"_ednref11\" name=\"_ednref11\" title=\"\">[11]<\/a> According to the Xinhua report, the court heard that Tohti coerced students to join Uyghur Online and to thereby form a criminal group under his leadership aimed at \u201csplitting the country.\u201d<a href=\"#_edn12\" id=\"_ednref12\" name=\"_ednref12\" title=\"\">[12]<\/a> Prosecutors asserted that more than 100 articles on the Web site contained \u201cseparatist\u201d content.<a href=\"#_edn13\" id=\"_ednref13\" name=\"_ednref13\" title=\"\">[13]<\/a> Prosecutors also alleged that Tohti and members of the criminal group he led \u201ccolluded with overseas agencies and individuals\u201d to \u201cinternationalize\u201d the \u201cXinjiang issue.\u201d<a href=\"#_edn14\" id=\"_ednref14\" name=\"_ednref14\" title=\"\">[14]<\/a><\/p>\n<p>According to both Xinhua\u2019s trial account and the CCTV broadcast, Tohti used his lectures at Minzu University to advocate \u201cXinjiang independence\u201d and incite violent resistance against the government.<a href=\"#_edn15\" id=\"_ednref15\" name=\"_ednref15\" title=\"\">[15]<\/a> In addition, Xinhua\u2019s trial account and the CCTV segment cite several instances in which prosecutors argued Tohti used Uyghur Online to distort violent events that took place in the XUAR and incite further violence.<a href=\"#_edn16\" id=\"_ednref16\" name=\"_ednref16\" title=\"\">[16]<\/a><\/p>\n<p>The CCTV video included excerpts from media interviews with three of Tohti\u2019s former students that prosecutors used during the trial.<a href=\"#_edn17\" id=\"_ednref17\" name=\"_ednref17\" title=\"\">[17]<\/a> The students, ethnic Uyghurs <a href=\"http:\/\/ppdcecc.gov\/QueryResultsDetail.aspx?PrisonerNum=10247\">Perhat Halmurat<\/a> and Shohret Nijat, and an ethnic Yi, Luo Yuwei, had also contributed to Uyghur Online.<a href=\"#_edn18\" id=\"_ednref18\" name=\"_ednref18\" title=\"\">[18]<\/a> In interview statements one of Tohti\u2019s lawyers asserted may have been made under official pressure,<a href=\"#_edn19\" id=\"_ednref19\" name=\"_ednref19\" title=\"\">[19]<\/a> the three stated that Tohti had forced them to post articles on the Web site that distorted facts about various incidents, and had threatened them with academic repercussions and physical violence if they failed to follow his orders.<a href=\"#_edn20\" id=\"_ednref20\" name=\"_ednref20\" title=\"\">[20]<\/a> The three men are reportedly among seven students prosecutors alleged comprised the criminal group Tohti led.<a href=\"#_edn21\" id=\"_ednref21\" name=\"_ednref21\" title=\"\">[21]<\/a><\/p>\n<p><strong>Arguments of Tohti\u2019s Defense Team <\/strong><\/p>\n<p>According to the official verdict, Tohti\u2019s defense team argued he was innocent based on the following points (among others):<a href=\"#_edn22\" id=\"_ednref22\" name=\"_ednref22\" title=\"\">[22]<\/a><\/p>\n<ul>\n<li>Beijing judicial authorities, and not Urumqi judicial authorities, should have jurisdiction over Tohti\u2019s case, since the charges against Tohti were based on crimes prosecutors alleged took place in Beijing.<\/li>\n<li>There is no legal basis for authorities\u2019 decision to try Tohti separately from the members of the \u201ccriminal syndicate\u201d he had allegedly led.<\/li>\n<li>Halmurat and others had worked for Uyghur Online of their own volition and in the absence of coercion and threats. There was no so-called \u201ccriminal syndicate.\u201d<\/li>\n<li>Reposting articles published by foreign media is an everyday normal occurrence, and does not constitute collusion with foreign forces.<\/li>\n<li>Tohti\u2019s acceptance of interviews with overseas media was legal and not separatist or criminal in nature.<\/li>\n<li>Tohti\u2019s criticism of state policies in his courses, articles, and interviews with media, were constitutionally protected expressions of his freedom of speech. The majority of the evidence prosecutors presented to the court showed that he had advocated the implementation of the XUAR\u2019s system of autonomy as stipulated in the Constitution. He had not advocated independence for the XUAR.<\/li>\n<\/ul>\n<p><strong>Lawyers Point Out Procedural Errors and Other Points of Concern in Tohti\u2019s Case<\/strong><\/p>\n<p>In media interviews and in online forums, Tohti\u2019s lawyers also raised additional concerns about authorities\u2019 handling of Tohti\u2019s case, including the following:<\/p>\n<ul>\n<li>Prosecutors failed to provide complete evidence for Tohti\u2019s defense team to review.<a href=\"#_edn23\" id=\"_ednref23\" name=\"_ednref23\" title=\"\">[23]<\/a><\/li>\n<\/ul>\n<ul>\n<li>The Urumqi Intermediate People\u2019s Court refused to call any of the witnesses Tohti\u2019s lawyers had requested to testify at his trial, including the three detained students interviewed by the media and featured in the CCTV video.<a href=\"#_edn24\" id=\"_ednref24\" name=\"_ednref24\" title=\"\">[24]<\/a><\/li>\n<li>The CCTV segment contains many distortions, particularly with regard to Tohti\u2019s alleged support of violence.<a href=\"#_edn25\" id=\"_ednref25\" name=\"_ednref25\" title=\"\">[25]<\/a> According to one lawyer, if viewers were to watch the entire three hours of Tohti\u2019s lecture containing the statements prosecutors alleged to have supported violence, they would come to a conclusion different from that of the prosecutors.<a href=\"#_edn26\" id=\"_ednref26\" name=\"_ednref26\" title=\"\">[26]<\/a><\/li>\n<li>The court of second instance\u2019s allowance of the publication of evidence against Tohti, in the Xinhua trial account and CCTV broadcast, constitutes a grave legal violation, as the trial court\u2019s decision had not yet entered into force when the media reports were made public.<a href=\"#_edn27\" id=\"_ednref27\" name=\"_ednref27\" title=\"\">[27]<\/a><\/li>\n<\/ul>\n<ul>\n<li>Statements made by Tohti\u2019s students while in official custody in January 2014, soon after they were detained, showed support for Tohti and his work, in contrast to later testimony critical of Tohti. One of Tohti\u2019s lawyers suggested that the students had likely made the critical statements against their will under pressure from authorities.<a href=\"#_edn28\" id=\"_ednref28\" name=\"_ednref28\" title=\"\">[28]<\/a><\/li>\n<li>Under Tohti\u2019s guidance, Uyghur Online had established guidelines not to support separatism, not to spread ethnic hatred, and not to propagate violence.<a href=\"#_edn29\" id=\"_ednref29\" name=\"_ednref29\" title=\"\">[29]<\/a><\/li>\n<li>Tohti had written that he had established Uyghur Online in order to increase understanding between Uyghurs and Han Chinese.<a href=\"#_edn30\" id=\"_ednref30\" name=\"_ednref30\" title=\"\">[30]<\/a><\/li>\n<\/ul>\n<p><strong>Health Concerns<\/strong><\/p>\n<p>Tohti\u2019s lawyers and his wife, Guzelnur, expressed concerns in recent months that authorities failed to provide adequate medical treatment for a number of serious physical ailments.<a href=\"#_edn31\" id=\"_ednref31\" name=\"_ednref31\" title=\"\">[31]<\/a> They stated that prison officials\u2019 weeks-long shackling of Tohti\u2019s ankles had caused them to become infected.<a href=\"#_edn32\" id=\"_ednref32\" name=\"_ednref32\" title=\"\">[32]<\/a> In addition, they said prison authorities failed to address complaints that fellow prisoners beat and otherwise harassed him.<a href=\"#_edn33\" id=\"_ednref33\" name=\"_ednref33\" title=\"\">[33]<\/a><\/p>\n<p><strong>Students Remain Under Detention <\/strong><\/p>\n<p>According to media reports, in addition to <a href=\"http:\/\/ppdcecc.gov\/QueryResultsDetail.aspx?PrisonerNum=10247\">Perhat Halmurat<\/a>, Shohret Nijat, and Luo Yuwei, who appeared in the CCTV video, four other students who were involved with Uyghur Online, <a href=\"http:\/\/ppdcecc.gov\/QueryResultsDetail.aspx?PrisonerNum=10046\">Mutellip Imin<\/a>, <a href=\"http:\/\/ppdcecc.gov\/QueryResultsDetail.aspx?PrisonerNum=10229\">Atikem Rozi<\/a>, <a href=\"http:\/\/ppdcecc.gov\/QueryResultsDetail.aspx?PrisonerNum=10265\">Akbar Imin<\/a>, and <a href=\"http:\/\/ppdcecc.gov\/QueryResultsDetail.aspx?PrisonerNum=10285\">Abduqeyum Ablimit<\/a>, remained in detention as of late September 2014.<a href=\"#_edn34\" id=\"_ednref34\" name=\"_ednref34\" title=\"\">[34]<\/a> One of Tohti\u2019s lawyers expressed concern that the students may be tried in secret,<a href=\"#_edn35\" id=\"_ednref35\" name=\"_ednref35\" title=\"\">[35]<\/a> and said authorities had held them in solitary jail cells and shackled their legs.<a href=\"#_edn36\" id=\"_ednref36\" name=\"_ednref36\" title=\"\">[36]<\/a> Overseas media reports indicated that as of late September 2014, authorities had not allowed the students access to lawyers or visits from their family members.<a href=\"#_edn37\" id=\"_ednref37\" name=\"_ednref37\" title=\"\">[37]<\/a><\/p>\n<p><strong>Background: Tohti\u2019s Detention and Threats Against Him and His Family <\/strong><\/p>\n<p>On January 15, 2014, security personnel detained Tohti in a raid of his home in Beijing, in apparent connection with his public discussion of Uyghur rights issues.<a href=\"#_edn38\" id=\"_ednref38\" name=\"_ednref38\" title=\"\">[38]<\/a> Authorities had subjected Tohti to harassment, arbitrary detention, and restrictions on his movement prior to his January 2014 detention.<a href=\"#_edn39\" id=\"_ednref39\" name=\"_ednref39\" title=\"\">[39]<\/a> In late 2013, authorities warned Tohti not to speak to journalists,<a href=\"#_edn40\" id=\"_ednref40\" name=\"_ednref40\" title=\"\">[40]<\/a> after he voiced concerns to the media regarding security measures and discrimination in the XUAR.<a href=\"#_edn41\" id=\"_ednref41\" name=\"_ednref41\" title=\"\">[41]<\/a> Tohti reported that plainclothes security agents in Beijing rammed his car on November 2, 2013, with his wife and two children inside, threatening him after he exited the car that they \u201cwanted to kill [his] whole family.\u201d<a href=\"#_edn42\" id=\"_ednref42\" name=\"_ednref42\" title=\"\">[42]<\/a><\/p>\n<p><strong>Opinion of the UN Working Group on Arbitrary Detention <\/strong><\/p>\n<p>In April 2014, the UN Working Group on Arbitrary Detention issued an opinion stating that Tohti was being arbitrarily detained.<a href=\"#_edn43\" id=\"_ednref43\" name=\"_ednref43\" title=\"\">[43]<\/a> The Working Group called upon the Chinese government to \u201cimmediately release\u201d Tohti, and to \u201cgrant him compensation for the harm he has suffered during the period of his arbitrary detention.\u201d<a href=\"#_edn44\" id=\"_ednref44\" name=\"_ednref44\" title=\"\">[44]<\/a><\/p>\n<p>For more discussion of the January 2014 arrest of Tohti and his students, see Commission Analysis, <a href=\"http:\/\/www.cecc.gov\/publications\/commission-analysis\/chinese-authorities-arrest-uyghur-scholar-ilham-tohti-and-students\">Chinese Authorities Arrest Uyghur Scholar Ilham Tohti and Students<\/a>.
